Official Rules of the Campaign "Giveaway Enroush - Menstruation Pseudonyms" December 17, 2024 - December 22, 2024

SECTION 1. THE ORGANIZER AND OFFICIAL CAMPAIGN REGULATIONS

1.1 The "Giveaway Enroush Products - Menstruation Pseudonyms" Campaign is organized and conducted by ENROUSH SRL (hereinafter referred to as "Organizer"), a company organized under Romanian law, with registered office in Bucharest, Sector 2, Str. Frunzei, nr. 26, office E3 02, et. 3, registered with the Trade Register under no. J40/295/2017, European Unique Identifier (EUID) ROONRC.J40/295/2017, Tax Identification Code 36916107, www.enroush.ro, represented by its administrator, Hîrdău Genica,

1.2 By participating in this campaign, participants agree to respect and comply with all provisions, terms and conditions of these Regulations as set out below.

1 .3 The Official Rules are drawn up and will be made public in accordance with the applicable laws of Romania by publication on the website www.enroush.ro, and will be available free of charge to any participant throughout the duration of the campaign by accessing the aforementioned website.

1 .4 The Organizer reserves the right to modify or change these rules, and the changes shall come into force only after the modification of these rules and after prior announcement of these changes on the website www.enroush.ro.

SECȚIUNEA 2. AREA OF THE CAMPAIGN

2.1 The Campaign is organized and takes place in Romania.

2.2 The prizes will be put in possession/will be delivered to the winner exclusively in Romania.

SECTION 3. DURATION OF THE CAMPAIGN

3.1 The Campaign will be launched on 17.12.2024 and will run until 22.12.2024 at 23:59 on the Instagram profile @enroush, both in posts and stories, with the registration and awarding of prizes to participants to be carried out according to the mechanisms in Sections 4 and 5 of these Rules.

3 .2 The Organizer reserves the right to change the period and system of operation of the campaign during the course of the campaign, but not before announcing this publicly, as per section 1 above.

SECTION 4. RIGHTS AND CONDITIONS OF PARTICIPATION

4.1 Only Romanian and foreign citizens and residents, with permanent residence in Romania, who are over 18 (eighteen) years of age as of the date of the start of the campaign, i.e. as of 17.12.2024, who accept the terms and conditions of this Regulation, may participate in this campaign, subject to the conditions of participation mentioned in Section 4.

4. 2 By participating in this campaign, participants must have a public account, follow the Enroush Instagram page, reply in comments to the Enroush post with a pseudonym used for menstruation (either the one they use or one they have heard as common) and share the post in their own story, with the Enroush Instagram account tagging, within the period mentioned in section 3. 1.

4.3 Legal entities, persons providing services of any kind to the organizer, and their proxies or employees of the agencies involved in running the campaign, as well as their family members, are not eligible to participate in this campaign.

4.4 The campaign participation/eligibility conditions are: Participants must be over 18 years of age and residing in Romania; Participants must have a public instagram account for the validation of the participation, as well as on the date of the announcement of the winner; Participants must follow the Enroush instagram page and follow the Enroush instagram page on the date of the announcement of the winner; Participants must share on their story the Enroush post with the campaign announcement/giveaway on instagram and tag/tag @enroush in that shared story on instagram. Participants must respond in the comments to the Enroush post with a pseudonym used for menstruation (either the one they use or one they have heard is common)

SECTION 5. THE PROMOTION PRIZES are:-

- 1 (one) year of Enroush menstrual products for 10 winners (12 (twelve) ENROUSH products of your choice), worth a maximum of 400 (four hundred) lei each kit.

- Winners will be chosen by random draw.

SECTION 6. METHOD OF AWARDING THE PRIZES

6.1. The Campaign Prizes will be awarded by random draw, using an automated platform, carried out on 23.12.2024 and the winners will be announced in the Enroush Page story.

6.2 Campaign Prizes cannot be substituted for cash or any other good or service.

6.3 The Winners may also not request any change to the technical or other characteristics of the prizes won.

6.4. The prizes will be delivered to the Campaign Winners by a dedicated courier to the address communicated at the time of being contacted in the case of winning, within a maximum of 7 working days from the date of the announcement of the Winners.

6.5 Prizes will be awarded to the winners at the Organizer's expense.

6.6 The Organizer shall not be liable for delays in the delivery of the prize due to delays in the provision of services by its suppliers, courier services, etc.

6.7. Any error and/or omission in the personal data provided to the Organizer shall not entail the liability of the Organizer, the accuracy of the contact details provided by the Participants being the sole responsibility of the Participants.

SECTION 7. PROTECTION OF PERSONAL DATA

7.1 By entering and participating in the Campaign, the Participants and the Winner declare that they agree with the provisions of these Rules and agree that, in the event of winning, their personal data, namely: name, surname, telephone number, e-mail address, delivery address, will be processed and used for the organization of the Campaign and for the purpose of sending/gifting the prizes, as well as for advertising, marketing and publicity purposes, without any further obligation or payment.

7 .2 The Organizer undertakes to comply with the provisions of Regulation (EU) No. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR). As such, the Organizer undertakes to keep the personal data of the Participants of the Campaign confidential and to use them in accordance with the applicable legislation.

7.3 Campaign Participants have several rights with regard to the processing of personal data as set out below, namely:
- The right to request a copy of the personal data held by the Organizer about the participant;
- The right to correct any incorrect or incomplete personal data during the campaign period until 22.12. 2024 at 23:59;
- The right to object or restrict the use of personal data of participants by the Organizer;
- Right to withdraw consent to the processing of data processed on the basis of consent. Withdrawal of consent will not affect the lawfulness of processing on the basis of consent prior to withdrawal of consent;
- The right to erasure of the participant's personal data, in situations where the participant has withdrawn his/her consent, where processing is no longer necessary or where such processing is contrary to the law;
- The right to data portability which allows the participant to request the transmission of a copy of the processed data that the Organizer has received from him/her to another entity.
- Dreptul de a depune o plângere la Autoritatea Națională de Supraveghere a Prelucrării Datelor cu Caracter Personal și, de asemenea, de a apela la instanțele de judecată.

SECTION 8. FORCE MAJEURE

8.1 Force majeure is any event beyond the organizer's control, remedy or foreseeability, including the organizer's inability to do so, for reasons beyond the organizer's control, and the occurrence of which makes it impossible for the organizer to fulfil its obligations under the regulations.

8.2 If the above situation arises or force majeure intervenes which prevents or delays in whole or in part the execution of the rules and the continuation of the campaign, the organizer will be exonerated from liability for the performance of its obligations for the period during which such performance is prevented or delayed in accordance with Articles 1082 and 1083 of the Civil Code. If the organizer invokes force majeure, the organizer is obliged to inform the participants of the campaign of its existence within 5 (five) working days of the occurrence of the force majeure. The case of force majeure will be communicated on the Enroush Facebook and Instagram pages and on the organizer's website www.enroush.ro The organizer reserves the right to change the date of the winners' draw without prior notice to the participants.

SECTION 9. TERMINATION OF THE CAMPAIGN

This campaign may be terminated in the event of an event constituting force majeure or in the event of a change in the legislative framework, so that the organization and conduct of the promotional campaign would require an increase in the budget allocated to this project.

SECTION 10. LEGAL FRAMEWORK

This Regulation is in compliance with the provisions of O.G. No 99 / 2000 on the commercialization of market products and services, H.G. No 333 / 2003 Methodological Rules for the application of O.G. 99 / 2000 on the commercialization of market products and services and in compliance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

SECTION 11. DISPUTES

In the event of a dispute as to the validity of an entry, the decision of the committee is final. By participating in this Promotion, entrants agree to abide by and comply with all provisions, terms and conditions of these Rules. Any disputes arising between the organizer and the participants in the promotion will be settled amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts. The organizer reserves the right to change the dates and duration of the promotion and will make this public.

SECTION 12. OTHER REGULATIONS

12.1. Complaints regarding the prize won, made after the date of signing of the prize handover-receipt form, will not be taken into consideration and will not be the responsibility of the organizer.

12.2. In case of attempted fraud of the system, abuse or any act likely to damage the organizer's image, the organizer reserves the right to take all necessary measures to remedy the situation.

12 .3. The Organizer shall not be held responsible for any fact that makes it impossible to validate a winner and to resume the draw until another winner is validated, such as the impossibility to notify the winner in writing due to the fact that the winner has not received the messages, etc. The Organizer shall take all necessary measures to ensure that the Campaign is conducted under normal conditions as presented, but shall not be held responsible for any complaints, complaints from participants, which do not concern violations of the legal framework in force.

SECTION 13. OTHER CLAUSES

These rules for participation/participation are available free of charge to any applicant. It can be accessed on the website www.enroush.ro/giveaway-enroush-pseudonime-menstruatie. A request may also be sent by telephone on 0722 579 947 or by e-mail to contact@enroush.com. Drafted and authenticated by a notary public from the "Solemnis" Notarial Professional Notarial Society, with registered office in Bucharest, sector 1, str. G-ral Constantin Cristescu, nr. 2, parter, ap. 1, today, in an original copy and 3 (three) duplicates, of which 2 (two) have been issued to the Parties and 1 (one) will remain in the archive of the notarial company, together with the original.
